These Terms and Conditions (“Terms”) govern your access to and use of PaddlePro.com (the “Site”) and your purchase of products or services from PaddlePro (“PaddlePro,” “we,” “us,” or “our”).

Please read these Terms carefully. By accessing the Site, creating an account, placing an order, or otherwise using the Site, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use the Site.

1. ABOUT PADDLEPRO

PaddlePro is an online retailer specializing in paddle and racquet sports equipment, apparel, footwear, accessories, court equipment, and related products.

References to “PaddlePro,” “we,” “our,” or “us” in these Terms refer to the business operating PaddlePro.com.

2. ELIGIBILITY AND USE OF THE SITE

You may use the Site only for lawful purposes and in accordance with these Terms.

By making a purchase through the Site, you represent that you have the legal capacity to enter into a binding agreement.

You agree not to:

3. CUSTOMER ACCOUNTS

Certain features of the Site may allow or require you to create a customer account.

You are responsible for:

  • Providing accurate and current information;

  • Maintaining the confidentiality of your password and login credentials; and

  • Activity occurring through your account.

Please contact us promptly if you believe your account has been accessed without authorization.

We reserve the right to suspend or terminate accounts that we reasonably believe are fraudulent, abusive, being used for unauthorized commercial purposes, or otherwise violate these Terms.

4. PRODUCT INFORMATION

PaddlePro attempts to provide accurate product descriptions, photographs, specifications, availability information, pricing, and other product information.

However, manufacturers may change product specifications, colors, packaging, graphics, materials, dimensions, or other characteristics without notice.

Product images are provided for illustrative purposes. Colors and appearance may vary depending on lighting, manufacturing variations, and your device or display.

We do not warrant that every product description, photograph, specification, price, or other item of information on the Site will always be complete or error-free.

If a product you receive materially differs from its description, please contact us.

5. PRICING

Prices are displayed in U.S. dollars unless otherwise indicated.

We reserve the right to change prices at any time without notice.

The price charged for a product will generally be the price displayed when your order is submitted, subject to correction of obvious pricing or listing errors.

Promotional prices, clearance prices, coupon codes, manufacturer promotions, and other discounts may be subject to additional restrictions.

6. PRICING AND LISTING ERRORS

Occasionally, a product may be listed with an incorrect price, description, availability status, promotion, discount, or other information because of a typographical, technical, manufacturer, or other error.

We reserve the right to correct errors and to cancel or refuse orders affected by an obvious pricing, product, inventory, or promotional error, including after an order has been submitted.

If payment has already been collected for an order that we cancel, we will issue an appropriate refund.

7. ORDERS

Submitting an order does not necessarily mean that PaddlePro has accepted the order.

We reserve the right to accept, reject, limit, or cancel an order for legitimate business reasons, including:

  • Product unavailability;

  • Pricing or listing errors;

  • Suspected fraud;

  • Payment authorization problems;

  • Shipping restrictions;

  • Manufacturer restrictions;

  • Quantity limitations;

  • Suspected resale activity; or

  • Violation of these Terms.

If we cancel an order after payment has been collected, we will refund the applicable amount.

8. PAYMENT

You agree to provide accurate and authorized payment information.

Payment may be processed by third-party payment processors.

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize the applicable charges associated with your order.

We reserve the right to require additional verification before accepting or shipping an order.

9. SALES TAX

Applicable sales, use, or other taxes will be collected where required by law.

The amount of tax charged may depend on the product, shipping destination, applicable tax rates, and other factors.

10. SHIPPING

Shipping options, rates, estimated delivery times, and any free-shipping promotions are displayed on the Site or during checkout and may change periodically.

Any delivery date or transit time provided is an estimate and is not guaranteed unless expressly stated otherwise.

Delivery delays may occur because of circumstances outside PaddlePro’s reasonable control, including carrier delays, severe weather, natural disasters, labor disruptions, supply-chain issues, incorrect addresses, or other events.

Customers are responsible for providing a complete and accurate shipping address.

Additional charges resulting from an incorrect or incomplete address may be the customer's responsibility to the extent permitted by law.

Certain products or destinations may be subject to shipping restrictions.

11. FREE SHIPPING PROMOTIONS

PaddlePro may periodically offer free shipping based on order value, destination, product type, promotional period, or other criteria.

Current eligibility requirements will be displayed on the Site.

Free-shipping promotions may exclude certain destinations, oversized items, expedited services, special-order merchandise, or other products identified on the Site.

PaddlePro reserves the right to modify or discontinue shipping promotions prospectively.

12. IN-STORE PICKUP

Where offered, customers may select in-store pickup for eligible orders.

Customers may be required to provide identification or order information when collecting an order.

An order should not be considered ready for pickup until PaddlePro has provided confirmation that it is available.

13. RETURNS AND EXCHANGES

Eligible products may be returned in accordance with PaddlePro's return policy in effect at the time of purchase.

Unless otherwise indicated for a particular product, promotion, or category, PaddlePro currently offers a 30-day return period for eligible merchandise.

Returned merchandise must generally be in the condition required by our current return policy.

Certain products may be excluded from return or may have special return conditions, including, where applicable:

  • Used merchandise;

  • Customized or personalized products;

  • Final-sale or clearance merchandise;

  • Undergarments or other hygiene-sensitive products;

  • Products damaged through misuse;

  • Products altered after purchase;

  • Special-order products; and

  • Other products identified as non-returnable at the time of purchase.

Nothing in this section limits any non-waivable consumer rights provided by applicable law.

14. REFUNDS

Approved refunds will generally be issued to the original payment method unless otherwise required or agreed.

Original shipping charges, expedited shipping charges, return shipping expenses, and similar charges may be non-refundable except where required by law or where the return results from an error by PaddlePro.

Processing times for refunds may vary depending on the payment provider or financial institution.

15. PRODUCT WARRANTIES

Many products sold by PaddlePro are covered by warranties provided by their respective manufacturers.

Unless PaddlePro expressly provides a separate written warranty, manufacturer warranty claims are generally governed by the manufacturer's warranty terms and should be directed to the applicable manufacturer.

PaddlePro may assist customers with proof of purchase or other information reasonably required for a manufacturer warranty claim.

Manufacturer warranty policies may change without notice.

Normal wear and tear, cosmetic damage, misuse, abuse, negligence, improper storage, modification, unauthorized repair, or use of a product for purposes other than those intended may not be covered by a manufacturer's warranty.

Customers should review the applicable manufacturer's current warranty terms.

16. LOW-PRICE GUARANTEE AND PRICE MATCHING

PaddlePro may offer a low-price guarantee, price match, or similar pricing program.

Eligibility, exclusions, verification requirements, participating products, time limits, and the amount of any adjustment are governed by the terms of the applicable program as displayed on the Site.

We reserve the right to verify competitor pricing and product availability before approving a price adjustment.

Price guarantees may exclude, among other things:

  • Clearance or closeout merchandise;

  • Used, refurbished, damaged, or open-box products;

  • Auction or marketplace sellers;

  • Unauthorized dealers;

  • Pricing errors;

  • Bundled offers;

  • Membership pricing;

  • Coupons or limited-time promotional codes; and

  • Products that are not identical.

The current program terms displayed on PaddlePro.com control in the event of a conflict with a general description elsewhere on the Site.

17. PADDLEPRO REWARDS

PaddlePro may offer a loyalty or rewards program through which eligible customers can earn and redeem points.

Points may be earned through qualifying purchases and other eligible activities identified on the Site.

Rewards points:

  • Have no cash value;

  • Cannot be exchanged for cash;

  • Are not transferable except where expressly permitted;

  • May be subject to expiration or account requirements;

  • May be adjusted to correct errors, returned purchases, canceled transactions, fraudulent activity, or abuse; and

  • Are subject to the current PaddlePro Rewards program rules.

PaddlePro may change the methods for earning or redeeming points, point values, available rewards, promotional bonuses, or other program features prospectively.

We reserve the right to suspend or terminate participation where we reasonably determine that a member has engaged in fraud, manipulation, abuse, or other misuse of the program.

Any termination or material modification of the Rewards program will be handled in accordance with applicable law.

18. REFERRAL PROGRAM

PaddlePro may allow customers to earn rewards for referring new customers.

Referral rewards are subject to the program rules displayed on the Site.

PaddlePro may reject or reverse referral rewards resulting from self-referrals, duplicate accounts, canceled or returned purchases, fraudulent activity, automated referrals, or other attempts to manipulate the program.

19. PROMOTIONS AND COUPON CODES

Coupons, promotional codes, giveaways, contests, sales, and other promotions may be governed by additional terms.

Unless expressly stated otherwise:

  • Promotions cannot be combined;

  • Promotions have no cash value;

  • Promotional discounts apply only to eligible merchandise;

  • Some brands or products may be excluded;

  • Promotions may have expiration dates; and

  • Promotions cannot be applied retroactively to previous purchases.

We reserve the right to cancel or modify a promotion in the event of fraud, technical problems, errors, or circumstances that materially affect the promotion, subject to applicable law.

20. GIFT CARDS AND STORE CREDIT

If PaddlePro offers gift cards, merchandise credits, or store credits, their use is subject to any additional terms disclosed when they are issued or purchased.

Gift cards and credits are not redeemable for cash except where required by law.

21. PRODUCT REVIEWS AND USER CONTENT

The Site may allow customers to submit product reviews, photographs, comments, questions, or other content (“User Content”).

You retain ownership of content you create, but by submitting User Content to PaddlePro, you grant PaddlePro a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and publish that content in connection with PaddlePro's business, Site, marketing, and promotion, subject to applicable law.

You represent that you have the right to submit the content and that it does not:

  • Infringe intellectual property or privacy rights;

  • Contain unlawful, threatening, defamatory, or obscene material;

  • Contain malicious software;

  • Contain knowingly false or misleading information; or

  • Violate applicable law.

PaddlePro may moderate or remove User Content that violates these Terms or our policies.

22. INTELLECTUAL PROPERTY

The Site and its original content, design, graphics, text, photographs, logos, icons, software, and other materials are owned by or licensed to PaddlePro and are protected by applicable intellectual property laws.

You may use the Site for your personal, non-commercial shopping and informational purposes.

You may not reproduce, modify, distribute, publish, sell, commercially exploit, or create derivative works from PaddlePro-owned Site content without our prior written permission.

23. THIRD-PARTY TRADEMARKS

Product names, manufacturer names, trademarks, logos, and other brand identifiers appearing on PaddlePro.com may be owned by their respective owners.

The sale or display of third-party products does not transfer any ownership rights in those trademarks to PaddlePro or its customers.

24. THIRD-PARTY LINKS AND SERVICES

The Site may contain links to manufacturer websites, payment providers, social media platforms, sports organizations, and other third-party services.

PaddlePro does not control these third parties and is not responsible for their websites, content, privacy practices, availability, or services.

Your interactions with third-party services are governed by the terms and policies of those third parties.

25. PRODUCT USE AND SPORTING ACTIVITIES

PaddlePro sells sporting goods and related equipment.

Participation in sports and recreational activities involves inherent risks of injury.

Customers are responsible for selecting products appropriate for their intended use, skill level, physical condition, and applicable rules or regulations.

You should follow manufacturer instructions, safety warnings, governing-body rules, and appropriate safety practices when using sporting equipment.

Nothing on PaddlePro.com should be interpreted as medical, safety, or professional advice.

26. GOVERNING-BODY APPROVALS

Some products may be described as approved, certified, legal, or compliant with the rules of a sporting organization or governing body.

Such approvals and equipment standards may change.

Unless expressly stated otherwise, PaddlePro does not control the rules or certification decisions of independent sporting organizations.

Players participating in sanctioned competition are responsible for confirming that their equipment complies with the current rules applicable to their event.

27. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

PADDLEPRO MAKES NO WARRANTY THAT THE SITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.

PRODUCTS SOLD THROUGH THE SITE MAY BE SUBJECT TO WARRANTIES PROVIDED BY THEIR MANUFACTURERS.

NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LEGALLY BE EXCLUDED UNDER APPLICABLE LAW.

28. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PADDLEPRO AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS PURCHASED THROUGH THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PADDLEPRO'S AGGREGATE LIABILITY ARISING FROM A PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO PADDLEPRO FOR THE PRODUCT OR TRANSACTION GIVING RISE TO THE CLAIM.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.

29. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless PaddlePro and its affiliates, officers, employees, and agents from claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the Site, your violation of these Terms, or your infringement of the rights of another person.

30. FRAUD AND ABUSE

PaddlePro reserves the right to investigate suspected fraudulent activity involving orders, payments, returns, promotions, rewards, referrals, reviews, or customer accounts.

We may cancel orders, refuse transactions, suspend accounts, reverse improperly obtained rewards, or take other reasonable measures to protect PaddlePro and our customers.

We may cooperate with financial institutions, payment processors, carriers, manufacturers, law enforcement, or other appropriate parties when reasonably necessary to investigate suspected fraud or unlawful conduct.

31. PRIVACY

Your use of PaddlePro.com is also subject to our Privacy Policy.

If a dispute cannot be resolved informally, any legal proceeding shall be brought in a court of competent jurisdiction as permitted by applicable law.

Nothing in this section prevents either party from pursuing a claim in small claims court where eligible or exercising rights that cannot legally be waived.

36. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will remain in effect.

37. NO WAIVER

PaddlePro's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.

38. CHANGES TO THESE TERMS

We may revise these Terms periodically to reflect changes in our business, Site, policies, services, or applicable law.

Changes will become effective when posted unless otherwise stated.

The “Last Updated” date at the beginning of these Terms indicates when they were most recently revised.

Changes will apply prospectively to the extent required by applicable law.

39. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any additional policies or terms expressly incorporated by reference, constitute the agreement between you and PaddlePro concerning your use of the Site.

Product-specific warranties, promotional rules, and other separately disclosed terms may also apply to particular transactions.
